A third-party trust fund is a financial vehicle used by the Government of Canada to provide funding to provinces and territories.
A trust offers flexibility to the beneficiaries (provinces and territories), to either draw down any fund immediately or over an allocated period, according to their respective priorities and accounting practices.
A trust agreement (contract) is required to establish a trust. The Government of Canada, as settlor of the trust agreement, provides funds to the trustee (a financial institution). The trustee is responsible for setting up the trust account(s), taking receipt of the funds, managing the funds, and disbursing the funds in accordance with the terms of the trust indenture or as directed by the beneficiaries (provinces and territories).
Trusts have been established for a minimum of two years. The Government of Canada establishes a notional allocation profile for the lifespan of the trust, although beneficiaries maintain full flexibility over fund withdrawals over the lifespan of the trust.
